1. Agreement to Terms
By accessing or using inAmber (the “Service”), operated by Capitalizt Ltd (Company No. 16890768, registered at 128 City Road, London, EC1V 2NX), you agree to be bound by these Terms of Service. If you do not agree, please do not use the Service.
2. Description of Service
inAmber is a platform for creating, encrypting, and scheduling delivery of personal messages (text, video, and audio) to designated recipients. Messages are encrypted end-to-end using AES-256-GCM. The Service includes a guardian network for message verification and delivery.
3. Account Registration
You must provide accurate, complete, and current information when creating an account. You are responsible for safeguarding your password and for all activities under your account. You must be at least 18 years old to use the Service. During the beta period, registration requires a valid invite code.
4. Payments and Subscriptions
inAmber offers various pricing tiers, from Single Seal (£9.99) to Forever Vault (£1,499). All payments are processed securely by Stripe. One-time payments are non-recurring. The Pro Monthly plan (£14.99/month) renews automatically until cancelled. Refunds are available within 14 days of purchase if no messages have been sealed.
5. Your Content
You retain full ownership of all content you create on inAmber. Your messages are encrypted before they reach our servers. We cannot access, read, or modify your encrypted content. You are responsible for the content of your messages and must not use the Service to transmit illegal, harmful, or abusive material.
6. Message Delivery
inAmber will make commercially reasonable efforts to deliver your messages according to the triggers you set (date, milestone, or other conditions). However, delivery depends on recipient contact information remaining valid and the guardian network functioning correctly. We cannot guarantee delivery in all circumstances.
7. Guardian Network
Guardians are trusted individuals you designate to verify delivery conditions. By appointing a guardian, you authorise them to confirm certain life events that trigger message delivery. Guardians do not have access to message content.
8. Data Protection
We process your personal data in accordance with our Privacy Policy and applicable data protection legislation including the UK GDPR and Data Protection Act 2018. See our GDPR page for your data rights.
9. Limitation of Liability
To the maximum extent permitted by law, Capitalizt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid for the Service in the 12 months preceding the claim.
10. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
